Fallujah Marine Case: Nazario Not Guilty On All Counts! UPDATE: NAZARIO IS GETTING HIS POLICE OFFICER JOB BACK

UPDATE: I just received information from the producer of Chandlers Watch:
I talked to Kevin McDermott yesterday he will be in studio this Saturday and told me Sgt. Nazario was in the Riverside Chief of Police’s office getting his job back yesterday afternoon.
Semper Fi,
Howie
————————————————————
Bash has one thing to say: This was bullshit…fukn bullshit…this should have never even been a case. Anybody that was in Fallujah when the Marines went in were either terrorists, or terrorist sympathizers because that city had been given lots of warning and tens of thousands of people left before we even went in.If you were in Fallujah when the Marines kicked ass there, you were a fucking terrorist that needed to be killed, period.Job well done.Semper Fi, Marines.Marine Sgt. Jose L. Nazario faced federal charges of voluntary manslaughter, abetting murder, assault with a deadly weapon and unlawfully using his firearm.
Assistant US Attorney Jerry Behnke had said, “This was an execution.”
Lead defense attorney Kevin B. McDermott didn’t dispute the government’s claim that the battle of Fallujah was a terrible event.
“You cannot describe Fallujah as anything but. It was horrible. It was in fact brutal,” McDermott said. “Don’t let the government turn [this] into a shooting on some street corner, in some home, in our country.”
In closing the former Marine lawyer warned the jury of the significance of their decision.
“This is the first time that this decision to take a life has been left to the decision of 12 people,” he said. “At the very least, we never want anyone ever to second-guess whatever they are doing at any point in battle.”
Nods to Sandy.

August 28th, 2008 at 1:56 pmThank G-d!! It never should have come to this, but thank goodness the jury saw through the bullshit.
August 28th, 2008 at 2:02 pmgreat news! but not unexpected
August 28th, 2008 at 2:03 pm“If you were in Fallujah when the Marines kicked ass there, you were a fucking terrorist that needed to be killed, period.
Job well done.
Semper Fi, Marines.”
Amen to that Bash!
August 28th, 2008 at 2:13 pmOUR TROOPS ARE NOT INHUMANE, THEY ARE IN FACT OUR BEST CITIZENS!!! I don’t think this case had any reason to go ahead in the first place, but thank God he was acquitted.
The question is, when will we start prosecuting those that make our brave troops fear the lawyers more than the enemies they fight in the field?
August 28th, 2008 at 2:14 pmpeople die in war, what else is there to say?
just let us soldiers and marines do our jobs with out having to worry about ridiculous rules

August 28th, 2008 at 2:15 pmYES!
YES!
YES!
FUCKIN-A-RIGHT!!!

August 28th, 2008 at 2:18 pmwhere’s murtha????
he is not saying anything?????
he had so much to say at the beginning before any due process, now his office says he does not comment on cases until they are completed.
to the marine

August 28th, 2008 at 2:23 pm“The question is, when will we start prosecuting those that make our brave troops fear the lawyers more than the enemies they fight in the field?”
I agree.
I would like to see Nazario file a suit now for the damages caused by the puke that brought this suit against him to recoup some of the losses he sustained during this whole ordeal.
Nazario and his family deserve to have compensation. My God they cost him his job as a police officer, made it impossible for him to get any other employment, made his family and him suffer needlessly, and for countless other reasons they deserve to be restored to what they had prior to this happening to them after his loyal and brave service to our country.
May God always bless Nazario and his family!
August 28th, 2008 at 2:30 pmHe SHOULD sue the ass of the guy who brought up the charges for slander. I’m thinking something in the area of $40 million is in order, considering it was slander for the whole Corps
August 28th, 2008 at 2:37 pmAssistant US Attorney Jerry Behnke had said, “This was an execution.”
welcome to the war zone…people die,,,some deserve it and some don’t…who wants to second guess???? let him go in first..
August 28th, 2008 at 2:37 pmSorry about that I left a “0″ out of the $400 million
August 28th, 2008 at 2:37 pmThis is great news!
BTW
August 28th, 2008 at 2:42 pmThe jihadi in the pic must have gotten sleepy,
he’s taking a little nap.
If anyone wants to give words of encouragement to
Assistant US Attorney Jerry Behnke, here’s where to go:

August 28th, 2008 at 2:48 pmGod help us if the Democrats take control.
August 28th, 2008 at 3:03 pmWe’ve done to our soldiers what we’ve done to our cops. And we have the same results: More dead cops and soldiers, and a less safe America.
August 28th, 2008 at 3:23 pmGood news. The sad thing is that his life is forever ruined. He will be near impossible to find a job as a police officer again and I would imangine that his finances are in shambles. I doubt that a lawsuit would be viable because of official immunity. There would have to be an epic, Duke Lacrosse type action to hold the prosecutor accountable. I hope they do, but it is iffy.
August 28th, 2008 at 3:32 pmRegrettably I think you may be right about his immediate future.
I don’t know how current this link is.

Lord willing, if He blesses my efforts with my homegrown animation studio, the tithe of my first film will go to the Haditha Marines, and I will do whatever I can (including offering them employment) to help set their lives aright. It is the least that we civilians can do to say (however unworthily we are to say it) “Semper Fi, Marine; well done!”
August 28th, 2008 at 4:05 pmThanks for supporting our troops murtha! NOT

August 28th, 2008 at 4:33 pmBlessed are the peacemakers “OUR Warriors” granted to us in grace by our Creator.
August 28th, 2008 at 4:51 pmTwo thoughts,
1) It is pathetic that this had to go forward but I think the good that will come out of it will be far reaching. As these decisions(there will be more) stack up, prosecutors will have to think twice before bringing up a case that will FUBAR their reputation and win percentage.
2)Vanessa
“The Peacemakers” I’d like that on a Marine or inter-service t-shirt. Maybe we could rename the Dept of Defense, the “Department of Peacemaking”. I can just hear the hippies heads exploding now.
August 28th, 2008 at 5:14 pmTo Kevin McDermont:
August 28th, 2008 at 5:14 pmThank you for the great representation Marine.
Sempre Fi,
Marc
Chandler’s Watch
He looks sooo “peaceful”, like a little angel…a little dead angel.

August 28th, 2008 at 5:17 pmI am glad he is not guilty. Marcus luttrell mentioned this in lone survivor-kind of pathetic
August 28th, 2008 at 5:27 pmOne down and two to go!
Kevin McDermott is going to sound off on Chandler’s Watch this Saturday about the Nazario case. Stay tuned.
August 28th, 2008 at 5:40 pmYes,Yes,Yes.
August 28th, 2008 at 6:36 pmPutting this Marine through this was a gross mis-carriage of justice.
August 28th, 2008 at 6:59 pmI am infinitely relieved he was acquitted.
If they keep this sort of thing up NOBODY who ever served in combat is safe.
Just UNBELIEVABLE that this ever came to trial.
Guess the damned prosecutor had nothing better to do or is some anti-military a$$hole.
Soembody should file attorney disciplinary charges against the prosecutor. This kind of sh-t should not go unpunished.
August 28th, 2008 at 7:18 pmThis is a happy day!!!!!!!!!!!
Message to the Kangaroo court…don’t try this shit again!
Stop wasting the nations time with bullshit and go after the real criminals and terrorists who infest our nations streets.
Billy
August 28th, 2008 at 8:46 pmSo much for being framed. He was tried by the MSM before he went to court. The media found him guilty without any evidence.
So there is justice!

August 29th, 2008 at 12:30 amThe right verdict of course. But, we still need to work on getting the system to not do these things. We should work to ban civilian courts from prosecuting anything that happens in combat.
August 29th, 2008 at 2:45 am… RAH!!! Semper Fi Marine!!! Now lets go after the idiot scumsucking traitors who brought these charges against him!!! Thanks for the update Bash!!! Sgt. Jose L. Nazario, thank you for your valued service to America!!!
August 29th, 2008 at 4:34 amAnyone know of an address or website to send him a donation. He’s currently unemployed from the Riverside Police Department. They fired him after the charges were filed. I’m sure he needs both emotional and financial support.
August 29th, 2008 at 4:39 amThis was put up by:

PDizzle
Regrettably I think you may be right about his immediate future.
I don’t know how current this link is.

Ok, now that he has been acquitted, we need to go after the throat of the prosecutor and those that pushed it. WE need justice. WE need to know that the scumbag will never put one of our troops in front of the firing squad, one of US in front of the firing squad, for simply DOING OUR FUCKING JOBS.
These treasonous fucks need to know that we are serious, and seriously pissed about it.
August 29th, 2008 at 6:23 amOh, and after we go for the prosecutor’s throat, we need to go after the Riverside Police Chief for forgetting that you are innocent until fucking PROVEN guilty.
Think he’ll get his job back? Think he’ll even WANT it? How about that comfortable lifestyle paid for by the taxpayers and an overzealous Police Chief who decided to fire an innocent man for charges that were complete bullshit and he knew it? This is a conspiracy to destroy the nation’s military and its stability. Its a conspiracy to destroy the accomplishments of those who have seconds to make lifetime decisions.
Just remember folks, this is a game to them. They don’t care whose life they fuck up and put down the gutter.
August 29th, 2008 at 6:29 amMarines are trained to kill the enemy and destroy his equipment - an entirely non-civilian undertaking, which has no business being debated or prosecuted in civilian courts.
God bless Marine Sgt. Jose L. Nazario, and all of the “Haditha” Marines, and may He restore some semblance of a good life to them for their service.

August 29th, 2008 at 7:02 amgood to know, this shouldnt have ever been a case.
i was fuckin furious when I saw the story on this.
August 29th, 2008 at 11:00 amSemper Fi boys. Anyone who even thinks they can stand up against our Marines deserves to die
August 29th, 2008 at 3:49 pmThat is so awesome!
Thank you for looking further into this Howie!
He deserves that and so much more.
August 29th, 2008 at 5:41 pmI am glad he has his job back though.
This was among the biggest tragedies of the war!!!
Semper Fi, Jose Navario
left liberal scumbags
August 29th, 2008 at 7:13 pmOne of the Corpsman that works with me was there with him and was called to testify in the case. He said out of the whole ordeal one of the worst things for Sgt Nazario was when the case was announced “United States of America vs Nazario.”
As a Marine to hear that your country is charging you with a crime when you were doing your duty in combat just rips at your heart and soul.
There is no amount of money that can give back what was taken from this Marine.
August 30th, 2008 at 1:14 pmWould you WANT the job back? They fired him for charges that he was proven innocent of. They didn’t wait for the outcome, they jumped to the conclusion that he was toast, and rid themselves of the hassle. They didn’t stand by him, knowing him as an officer and a friend, they sent him packing. I am not sure I would take the job back. I realize he needs employment, but that goes beyond need.
I agree, the prosecutor needs to hear from us. I have sent my letter this morning.
I am dumbfounded…
August 30th, 2008 at 1:19 pmMaybe we could rename the Dept of Defense, the “Department of Peacemaking”.
I much prefer going back to the “War Department” designation. Tried and true, no peacemaking, nation building, false procecutions or political grand-standing.
