Minnesota Court Declares Franken Leading Vote-Getter in 2008 Senate Race
After a statewide recount and seven-week trial, Franken stands 312 votes ahead.

ST. PAUL, Minn. — A Minnesota court confirmed Monday that Democrat Al Franken won the most votes in his 2008 Senate race against Republican Norm Coleman, who had already announced plans to appeal the decision.

Coleman has 10 days to appeal to the state Supreme Court. Once the petition is filed, it could further delay the seating of Minnesota’s second senator for weeks.

After a statewide recount and seven-week trial, Franken stands 312 votes ahead. He gained more votes from the election challenge than Coleman, the candidate who brought the legal action.

The state law under which Coleman sued required three judges to determine who got the most votes and is therefore entitled to an election certificate, which is now on hold pending an appeal.

“The overwhelming weight of the evidence indicates that the November 4, 2008, election was conducted fairly, impartially and accurately,” the judges wrote. “There is no evidence of a systematic problem of disenfranchisement in the state’s election system, including in its absentee-balloting procedures.”

In its order, the judicial panel dismissed two attempts by Coleman to subtract votes from Franken over allegations of mishandled ballots in Minneapolis.

The judges also rejected Coleman’s argument that a state board improperly made up for a packet of ballots lost between the election. His lawyers conceded that the ballots’ disappearance rendered them invalid and that Coleman was entitled to review all ballots as part of the recount.

Coleman’s lawyers claimed dozens of ballots were double-counted when their originals couldn’t be fed into optical scanning machines on Election Day. They said it was possible that originals and duplicates were included in the recount.

The ruling diminishes Coleman’s chances of retaining a seat that he won in dramatic fashion in 2002, when he narrowly defeated former Vice President Walter Mondale. Democratic incumbent Paul Wellstone died in a plane crash with two weeks to go in the campaign.

Franken, a former “Saturday Night Live” comic, entered the Senate race more than two years ago. A third-party candidate’s strong showing left Coleman and Franken virtually deadlocked on Election Night, triggering an automatic recount of 2.9 million ballots. Coleman led by about 700 votes before routine double-checking of figures trimmed his edge to 215 votes heading into the hand recount. By the recount’s end in January, Franken had pulled ahead by 225 votes.

Coleman’s trial began in January and his appeal could push the race into May or beyond.

Coleman’s lawyers have said their appeal will mostly center on violations of the constitutional guarantee of equal protection, arguing that counties had differing standards in treating absentee ballots.

Franken’s attorneys argued that no election is absolutely precise and that all counties operated under the same standard.

In addition to the appeal, Coleman can also initiate a new action on a federal level. Either side can appeal an eventual state Supreme Court decision to the U.S. Supreme Court or throw the disputed election before the U.S. Senate, which can judge the qualifications of its members.

    This has NOTHING, NOTHING I tell you, to do with DISenfranchisement. Rather, this has EVERYthing to do with unlawful ENfranchisement. This has everything to do with giving the vote to Mickey Mouse and Abraham Lincoln. Everything to do with giving the vote to Mexicans and dead people. This election was rigged and no judge under the sun can make me believe that laws weren’t broken by the Frankenstein campaign. This I will stand by until the day I die.

    I also stand incredulous as each new piece of horrifying news comes in. It is nothing short of apocalyptic. Until this year, I would have scoffed at people who got apocalyptic on me. I mean, please, we’ve had bad times before and millenarian types have always been quick to take advantage of it. But the nature and speed with which these things are happening and the fact that they are almost uniformly evil is not something I can ignore.

    I had a bad feeling when Frankenstein announced his Senate run. I kept telling myself it couldn’t succeed but something so harebrained, so unlikely, probably had a very good hook-or-crook chance at success. This I sensed and the events since then have lined up like watching a golf ball roll toward the hole in slow motion. You keep hoping your opponent’s ball will miss but it keeps moving inexorably toward the hole – and you feel powerless, short of an act of God, to cause its failure.

    After Coleman won the initial count by over 700 votes, Franken’s attorneys out-lawyered Coleman’s during the recount process. Now, for Coleman to reclaim the win I believe he really had, he has to take it all the way to the U.S. Supreme Court to apply properly Bush v. Gore and rule that the Minesota vote counting violated equal protection of the law. The Minnesota court said it was not authorized to make a decision on the equal protection issue, but then said a few words anyway to help Franken.

    UGH! I expected this outcome from a dem controlled system. Coleman has a solid case as all of Franken’s “magical votes” came from highly questionable precincts at were overly libtard, in some cases more votes than registered and of course the “freshly found votes” days after the election. More so, the libtard counties and officials used very loose guidelines so more questionable votes were allowed for Franken than Coleman (meaning the republican areas actually counted fairly).

    Phil is right, the only way Coleman can win now is taking it to the SCOTUS since the libtard SCOMn failed to protect it’s citizen’s rights.

    Don’t blame all Minnesotans, we’ve been fighting this well oiled DFL machine for years. They are deeply entrenched in the system but were flushing them out. Unfortunately, the DNC, ACORN and others lawyered-up and out maneuvered the Coleman camp early-on after the election. They had a post-election battle plan with many operatives in place, Coleman did not.

    Ventura was an absolute fluke and actually got voted in by the young college dems because it was a prank vote. No one took Ventura seriously during the campaign, never asked him tough questions, never exposed him for the freak he is (although I commend him for his military service and entertaining me as a kid watching Saturday mornings).

    This is exactly why I moved out of MN years ago. It’s full of liberal, pantie waisted, pablem sucking sheeple. When I heard about Sen. Paul Wellstone corkscrewing in to the dirt while living in MO at the time I was so elated and overcome with joy that I almost shit my pants. He was the most liberal person in Washington at the time. Looks as though the people of MN have found a perfect replacement to continue the legacy. In the early 90′s the Twin City area was inundated with all the trash from the Chicago and East St. Louis area because of the ease to which they could get on some kind of social benefit programs that the people of “The land of 10,000 Taxs” love to subsidize. so much so that the “New immigrants” took to refering to Minneapolis as “Moneyapolis”.

    Following the recount via newspaper and online accounts it seem that no one even question if the people who are voting are U. S. citizens and are residents of Minnesota.

    Until someone finds a way to stop voter fraud and show some sort of voter I. D. this will happen again and again.

    I stayed in Loews Beverly Hills hotel years ago. My brother shared an elevator with Franken and told him to go fuck himself. We almost got thrown out of the hotel. I’m very proud of my brother for this wonderful comment.
