A new gun law being considered in Congress, if aligned with Department of Homeland Security memos labeling everyday Americans as potential “threats,” could potentially deny firearms to pro-lifers, gun-rights advocates, tax protesters, animal rights activists, and a host of others – any already on the expansive DHS watch list for potential “extremism.”

Rep. Peter King, R-N.Y., has sponsored H.R. 2159, the Denying Firearms and Explosives to Dangerous Terrorists Act of 2009, which permits the attorney general to deny transfer of a firearm to any “known or suspected dangerous terrorist.” The bill requires only that the potential firearm transferee is “appropriately suspected” of preparing for a terrorist act and that the attorney general “has a reasonable belief” that the gun might be used in connection with terrorism.

Gun rights advocates, however, object to the bill’s language, arguing that it enables the federal government to suspend a person’s Second Amendment rights without any trial or legal proof and only upon suspicion of being “dangerous.”

“[Rep. King] would deny citizens their civil liberties based on no due process,” objected Larry Pratt, executive director of Gun Owners of America. “A ‘known terrorist?’ Look, if the guy has committed an act of terrorism, we shouldn’t have to worry about him being able to buy a gun; he should be in jail!”

Pratt further warned WND of the potential overlap of H.R. 2159 and a recent DHS memo that warned against potential violence from “right-wing extremists,” such as those concerned about illegal immigration, increasing federal power, restrictions on firearms, abortion and the loss of U.S. sovereignty.

“By those standards, I’m one of [DHS Secretary] Janet Napolitano’s terrorists,” Pratt said. “This bill would enable the attorney general to put all of the people who voted against Obama on no-gun lists, because according to the DHS, they’re all potential terrorists. Actually, we could rename this bill the Janet Napolitano Frenzied Fantasy Implementation Act of 2009.”

Pratt’s biggest concern, however, is the sidestepping of the Constitution and due process that the nebulous language of this bill could permit.

“Unbeknownst to us, some bureaucrat in the bowels of democracy can put your name on a list, and your Second Amendment rights are toast,” Pratt told WND. “This is such an anti-American bill, this is something King George III would have done.”

As WND reported, right-wing “extremists” aren’t the only Americans on the DHS watch list.

Two weeks before the U.S. Department of Homeland Security penned its now notorious warning against “right-wing extremists” in the United States, it generated a memo defining dozens of additional groups as potential “threats.”

That memo, the “Domestic Extremism Lexicon” expanded the list from typical “right-wing” causes to include left-wing extremism, animal rights activists, black separatists, anarchists, Cuban independence advocates, environmental extremists, the anti-war movement and more. It even insisted some of these groups were prone to violence.

For example, the lexicon defined the “tax resistance movement” – also referred to in the report as the tax protest movement or the tax freedom movement – as “groups or individuals who vehemently believe taxes violate their constitutional rights. Among their beliefs are that wages are not income
, that paying income taxes is voluntary, and that the 16th Amendment to the U.S. Constitution, which allowed Congress to levy taxes on income, was not properly ratified.”

It further states that tax protesters “have been known to advocate or engage in criminal activity and plot acts of violence and terrorism in an attempt to advance their extremist goals.”

The DHS memos were meant for distribution to law enforcement officials around the country, prompting some to worry the definitions might be used to classify Americans who simply disagree with government policies as being dangerous.

As WND reported, the relative of a Louisiana driver claims her brother-in-law has already been unfairly targeted by police simply for having a supposedly subversive, “Don’t Tread on Me” bumper sticker on his car.

According to the relative, it happened this way: Her brother-in-law was driving home from work through Ball, La., which has a local reputation for enhancing its budget by ticketing speeders. He was pulled over by police officers who told him “he had a subversive survivalist bumper sticker on his car.”

“They proceeded to keep him there on the side of the road while they ran whatever they do to see if you have a record, keeping him standing by the side of the road for 30 minutes,” she told WND.

Finding no record and no reason to keep him, they warned him and eventually let him go, she said.

WND has withheld the driver’s name and the relative’s name at their request.

H.R. 2159 has six co-sponsors, from both parties, and has been referred to the House Committee on the Judiciary.

WND contacted Rep. King’s office
for comment on the bill, but received no response.

      Peter King is no Rino and stands with conservatives on almost every issue. I wish he was my rep but I’m stuck with Steve Israel, a liberal dipstick. I will say that King is off base on this one. He’s trying to combat potential terrorism but the language in the bill is too vague and the AG will have too much leeway to declare anyone a potential terrorist. This ain’t good, people.

    Once we are unmarmed we are no more than sheep to be herded when or where the government decides.

    I think that I will just say no to the confiscation of my guns. But, soon we will have to attend to and deal with this situation, because Obama wants all guns out of our hands. He and his government should consider me a non-participant in their firearms removal program. In fact, if it comes to that they should consider me a subversive.

    The time is coming when we will have to fight to take back this country. Hopefully we will see states secede from the union first, giving us some organizational legs to stand on, and giving us the ability to stop paying taxes to the federal government. That’s when Obambi will sent in the federal troops, when he knows the money is going to stop flowing in to Washington. Nothing less than that will prompt them to do much. It’s all about confiscating wealth and giving it to well connected bankers now, their largest political donors.

    :neutral: Look at it this way: consider the shredding of the Constitution over the last 4 months. If Oboy is to continue with the same agenda, which he obviously will, he HAS to take your 2nd Amendment rights away. There is NO OTHER WAY he can continue his socialist (read: slavery) programs with an armed populace. It comes down to whether or not people will be willing to physically defend themselves when Oboy makes his move. At this point, however, there is probably no peaceful way out of this, unless your representatives can be made to vote down these schemes. Time is not on the side of those who wish to maintain the US Constitution.

    The problem I see is that the poor SOB they send to take away you guns will probably be a local cop who is just being asked to enforce an unpopular legal decision.

    The question therefore is: “How many of our law enforcement and or National Guardsmen will have the courage to say no to what would certainly be an unconstitutional order?”

    Upon that question our liberty may rest … how many of us would be willing to use deadly force against a local cop or National Guardsman? I know that it would be a tough decision for anyone … and the local cop is going to certainly have mixed feelings …

    Perhaps that is why Obama is so eager for his national security force loyal to only him. Because if it was an ACORN knocking at my door the whole calculus changes …

      And therein lies our dilemma. The majority of us respect law enforcement officers and make reasonable efforts to be law abiding citizens. Many of us are former military and some still in the National Guard.
      Some of us are former or active law enforcement.

      Obama wants to turn us into outlaws for being concerned, patriotic Americans. He does this precisely to create dissension and confusion.

      I’ve been assured by many that military and law enforcement will side with patriots but it does little to allay the nagging doubts and fear. Reality is a hard teacher. How is a cop to decide the difference between patriots and outlaws?
      The shoot first ask questions later attitude has life changing consequences.

      That is why we have to foster as much support in law enforcement National Guard and Military circles as possible. Remember, there are a lot of cops who are thinking twice about enforcing what is unenforceable, the law will apply to THEM too, their duty weapon may be the only firearm permited them and then locked up in the Station when they go off duty.

      Don’t think for a second the Lawmen are not talking about this and what to do about it, you can be sure their discussed solutions is NOT what Maobama wants.

      I don’t know how many times I’ve heard cops tell me that they are just doing their jobs, and that if I don’t like the law, then I should work to get it changed.

      What they don’t touch on, is that I have worked to get the laws changed, but my voice and vote don’t mean jack shit in a corrupt system.

      well, I have read everyones response on here and I am aligned with all of you…except one thing keeps coming to mind…WTF were the cops thinking in La. when they pulled over the dude in the truck with the Don’t Tread on Me sticker???? were they a good example of some of the law enforcement out there that will side with the usurper that is destroying our Country? The libertards are forcing the Conservatives and the true Americans into a corner, and we all know what happens when a dog gets pushed into a corner….it comes out fighting cause it has no choice…I just pray the States resolve this prior to it getting to the people level!!! because once it gets to the people level, then we will have what we call a civil war. There should be a phone #, GMRS radio frquency, bat signal,,something to notifiy others that this is occuring at your place of residence. I plan on going down with a fight. May need help though. Who do I call to have 100,200-500 likeminded people show up at my house in a “peacefull” “show of force” read-solidarity to these JBT’s. What, are they going to arrest everyone?

    Guys, let’s not go off and engage in single acts of resistance in isolation. We are not yet organized in any feasible way, logistically, tactically, strategically, medically, or in terms of intel gathering. The best approach is to organize and to hide what you have. Hide it well and effectively, because we will need to do that. Plus, there are some people in DoD who we need, and we should be cooperating with each other. It would only enhance our chances of successful outcomes.

    Make sure if they show up at your residence they have a signed warrant to search your home. Make sure you are not hiding them within your home. Talk with each other about contingencies, and do not do this via electronic media. Be careful who you take into your confidence. The enemy’s greatest weapon is intel. But let’s make intel our greatest weapon and deprive the enemy of that asset.

    When Gen. Thomas Gage was sent to Boston by the King to disarm the populace in New England, they did the sensible thing: they hid the powder, shot, and weapons and made it very difficult for the Redcoats to find them. And they did not finally fight until it was organized and impossible to avoid. Learn from history. Think like a military person and never underestimate your enemy.

      Exactly so. If we foresee – and I think we do – the possibility of civil war/rebellion in the future, then we need to begin planning now. The very first thing we need to organize is ourselves. Next – intelligence gathering and spying. However, I would be very wary of accepting anyone who worked for the FBI, NSA, or Secret Service. Extremely wary, because they have no loyalties whatsoever to the Constitution. The FBI is an arm of the Justice Department, an inherently political creature.

      I rather suspect that we would need to be careful about the CIA too, but it is more likely that not we would find sympathetic people over there. Word is that they are very angry and demoralized over there. The anti-Bush faction was real and it was there, but perhaps a small group compared with those now hopping mad at Obonga. But they’ll have to be careful, because Leon Panetta is there to watch them, not run an intel organization according to what it is supposed to do.

      Not only pure intelligence gathering is desirable. We will need counterintelligence too, because the enemy will be working hard to penetrate us and our plans too. I am normally inclined to be reserved about the use of violence. I am inclined to be restrained with it unless necessary, but when you need to be then you need to be ruthless about it. Americans spying for the enemy against the people should be dealt with very harshly. And I’ll leave it at that. And it has to be done carefully too.

      There are many areas of expertise we do not have at present. This ‘aint no game, gents. This is really high stakes for the enemy and for us. The reward for them is world domination and the extinction of liberty forever. Our reward is our freedom and our country. There is no middle ground.

      This fight, if it comes, will be a lot like the partisan war waged on the frontier, in the Middle colonies and in the Southern colonies during the revolution. The war will be up close and personal. We will have to kill other Americans and they will be trying to kill us too. It will get ugly.

      That’s why I much, much prefer to resolve the conflict through political means, if at all possible. And I really mean that. No effort should be spared in that direction. That way, in the end, if we have to go down a sanguinary path it will be for the right reasons and because we have been left no other option. The reason why I argue restraint is because the enemy will try to portray us as the evil ones who threaten the nation. Their means of propaganda are formidable, so we should be very, very miserly about giving them the excuse to exercise it.

      In any event, if you want peace, prepare for war and be ready to use it.

      I beg to differ, but the people you want are those who know the system and are fed up with it the most. In my experience that includes many FBI and other letter agencies, I’m not saying trust them all, but there are people in those organizations or were former members that know a lot of damaging info and absolutely HATE Obama/Clinton and the other cabal of leftist retards now running things.

      Being threatened with “war crimes’ and other stupid nonsense by the Leftists for doing their best to catch bad guys and terrorists is just going to drive more of them to our side.

      No revolt, revolution or armed coup in history has succeeded unless there was internal help from the existing Military security/ intelligence services to help topple it.

We have always had the agencies to deal with any threat to America, yet this one additional agency, in the hands of statist thugs, is being used to threaten the very Americans it was designed to protect. The government was not given the authority to defend itself from Americans, it was given authority to protect and serve Americans. UPSIDE DOWN AND BACKWARDS.

      I’m from New Hampshire. I’m a Northeastern U.S. resident. You may be surprised, but there are a lot of folks, perhaps not the majority – yet – who don’t like the RINO’s and the Marxists.

      The way forward is to be united and together, not divided against each other by state and region. Besides, it is not fair to leave those of us in blue states to the “mercy” of the totalitarians and collectivists.

      I realize some may think I’m being a wimp by suggesting caution and planning, but that’s just the way it is folks. That’s the real world. If anyone goes half-cocked on this, trying to be a macho hot head it is going to fail and it will make things just all the more difficult for the rest of us to truly put together something durable and successful.

      BTW, I’m a veteran. Non-combat MOS, but nevertheless I do study history, have learned about military tactics and strategy, and I have learned by studying history how things have a chance of succeeding and how things can go south very quickly.

      I am a true American who believes in the Constitution and in the Declaration of Independence. I believe in our traditions. I’m a practicing Roman Catholic and am no terrorist. Which means there are things I will not do under any circumstances. I will not go off half cocked and ill-disciplined at any time. But I will defend my country and it’s people any time anywhere.

      I’m just saying we are, as best I can see, not in any condition to storm the barricades, gentlemen. Which means there is work to be done. But we absolutely must exhaust the political process. Armed resistance must be the absolute last resort and should only be undertaken after sound preparation and organization make success a very distinct possibility.
