KWTV: OHP claims the dispute started after the ambulance failed to yield to troopers who were responding to call. Once the troopers finished their official business, they pulled over EMS as paramedics were transporting a patient inside. That patient was Kenyada Davis’ mother. Davis shot this video of the confrontation after paramedics were pulled over.

    Straight up:
    He was resisting arrest by pushing the officer away, and for that alone could have been cuffed.

    But… is it procedure to choke a guy with your hand like that?

    Also:
    The interesting twist here is the Creek Nation Indian connection. We have problems with the tribes out here in the Coachella Valley and the law in and around Casinos. The African American dude’s not an Indian, but he works for ‘em. Were they on Indian land when this went down?

    There are all kinds of odd legal issues when it comes to Reservations and who has jurisdiction.

    I’d like to know more, just for entertainment value.

    Two points, DesignR:
    1) The police officers know where the ambulance is going. There should have been no arresting an EMT and stopping an ambulance with a patient inside without REAL good reason. I might have resisted arrest (and I did) if a police officer attempted to get inbetween me and my patient.
    2) This suggests some issue between the EMT company and the police that should be resolved. EMTs and Police usually work together.

      (1) Yes.
      I 100% understand your point. Life is precious, get the patient to the Hospital ASAP, overriding any other petty issue. They can sort out the beef at the Hospital.

      That said;
      The police, right or wrong, did stop the vehicle. I suppose he could have entered into a police chase, but he stopped, probably to explain the need to get to the Hospital. It sounds like the Police were REALLY wrong this time, even if the EMT driver did flip them off! They could have cuffed him after dropping the patient off.

      Fact: the EMT driver was under police control at that time, quote: “You are under arrest, you are under arrest..”. The police have the guns. He pushed one officer away and turned to get into the vehicle. I don’t know what was said before this. There should have been some kind of logical dialogue with regard to the patient at that time, saying “Let’s finish this after I get this woman to the Hospital”. It sounds like everybody was angry and seeing only red. NONE of this should have happened.

      Now, in my post above, I was wondering why the ‘odd choke hold’ in any event? I’ve never seen that before. That loose choke hold left the guys hands free. It did not look ‘according to Hoyle’.

      (2) Yes.
      Something was up that needs resolution between the two. That was my second point.

      There must be some ongoing power struggle between the police and the Indian Nation (EMT employers). Or, were the police ALSO employed by the Indian Tribe? We have those kinds of issues out here. Indian land is like a sovereign nation unto itself. They have their own tribal legal counsels, and occasionally their own police and fire personnel. They need to iron things out behind closed doors, not on the street.

    The bad news might be, are we going to have to deal with these ‘out of control’ cops? Hitler found his brownshirts in taverns. Will Obama find his already wearing a badge?

    A friend of mine who became a LA County deputy sheriff told me that most police officers see everyone as a perp. I asked him if they saw their fellow officers as perps. He laughed and said, sometimes.

    We got a judge who thinks it’s funny to legislate from the bench. Do we have police officers who find it funny to act like thugs with badges? Is NOPD the only police force that would abandon a city in crises? I know the LAPD did during the LA Riots.

    Is it too late to approach police officers and inquire as to their motivations, allegiances and understanding of their oaths?

  7. My guess is that there is more to this story that prceeds this event.  This absolutely should have been resolved/addressed after the patient had been transported. Generally there is a mutual respect between the police and fire/EMS. If emergency services does something boneheaded it is usually addressed afterwards.
    I have to say that I have not seen or heard of an occurrence such as this. Has anyone else??

  8. As a former “Okie” I feel I have the right to comment on this situation. It stated that the ambulance failed to yeild to the Troopers who were on a call. This means that the Troopers were running
    “code” and needed to get to there call ASAP. They could have been going to save another life. The ambulance was not running “code” and should have yielded. The woman was being transported for heat exhuastion. If I were running “code” and an ambulance was not getting out of my way I would have been pissed. The Troopers have jurisdiction to run calls on the highway and within the whole state regardless of it being within the Indian Nations boundries. The OHP is one of the best trained Hp’s in the country. I feel that they were justified in there action. (Not the hold around the neck.)The EMT driver clearly had an attitude.

      Ahhhhh, makes much more sense by your explanation Aaron. The confusion arises from the use of he term “pull over” - it has multiple meanings.

      Ambulance, not running code, didn’t “pull over” {{as in to YIELD the highway to the Troopers}} on a call.

      Asshole EMT flips off troopers, whom he is blocking from their code call.

      Troopers “pull over” ((as in to stop the vehicle)) for failure to yield to an emergency vehicle.

      It’s all about training and good management. There are good and bad cops. It takes time for management to find the bad ones and eject them. I think they will need to hire a couple of new ones soon.

      Oh, I just got a clear way to explain it!

      It’s a simple case of Road Rage on the cop’s part, started by an EMT acting unprofessionally by flipping them the bird. Both parties thought they had the higher ‘right’ to the roadway, so a dick measuring match or if your prefer a pissing match ensued.

      The lady in the back of the ambulance and the person needing the police lost. In other words, the public lost, all because of a petty road ‘right of way’ power rivalry.

    20 years ago as the dude who hired - and fired Maurice I “feel a need to comment” as well.
    Maurice is smart, but had anger control issues. He is also very big, (that Officer was not short).
    The Choke was childish And Stupid. You were right Even a little guy with free arms could have taken stupid trooper out. I know Maurice well enough to know he was trying very hard, and doing well controlling his anger.
    I read Maurice’s report. (remember I fired him and I did not trust him) But the report was logical and fit the video.
    I HOPE NO ONE thinks this means Ambulances must use lights & siren. I taught Maurice better. Very few patients, especially a hysterical woman who believes she is having a heart attack need a siren. It is as effective as I.V. Adrenalin in impairing the judgment of the crew and exacerbating the condition of the patient.
    As an experienced health professional you establish a relationship of trust very early with your patient. Remember they dialed 911 because they and their family have a situation out of control.
    Only a true EMS professional who has been there really understands the tenuous connection I know he had with that very frightened woman. That is a TRUST connection.
    We often came into conflict with the opposite ‘connection’ of Mis-trust cops have with their perp.
