Only Shoot The Bad Guy Once: Pharmacist Who Shot Man Robbing Store Charged With Murder

OKLAHOMA CITY — An Oklahoma City pharmacist who shot and killed a 16-year-old would-be robber was charged Wednesday with first-degree murder.

Jerome Ersland, 57, was being held without bail in the Oklahoma County Jail.

Oklahoma County District Attorney David Prater said in an afternoon news conference that Ersland was justified in shooting Antwun Parker once in the head on May 19. But Prater said Ersland went too far when he shot Parker five more times in the abdomen while Parker lay unconscious on the floor.

Ersland’s attorney, Irven Box, said Ersland was protecting himself and two women inside the pharmacy.

“I think he did something in his eyes that protected both himself and two ladies in there,” Box said. “He put an end to the threat.”

Box said he thinks a jury will exonerate Ersland.

At an afternoon news conference, Prater showed a security video in which two men burst into the pharmacy and one is shot.

Ersland is seen chasing the second man outside before returning, walking past Parker to get a second gun then going back to Parker and opening fire.

The charge alleges Ersland shot Parker while he was incapacitated and lying on his back. Ersland’s account of the incident doesn’t match the video or the evidence collected at the scene, according to an affidavit written by Oklahoma City Police Detective David Jacobson.

Jacobson said the suspect who ran away from the pharmacy was armed, but no gun was found near Parker.

“Ersland shows no concern for his safety as he walks by Parker, and turns his back to Parker as he walks behind the pharmacy counter,” Jacobson said. “Ersland is then seen to put the pistol he is carrying on the counter, and retrieve a second pistol from a drawer.”

Ersland used this pistol to shoot Parker on the ground, the detective said.

He said an autopsy determined that Parker had been shot in the head, but was still alive when he was shot in the stomach area and died from those injuries.

    If the guy was moving around when he was shot then he was still a threat, if he was not moving around than after being shot in the head you would have presumed him to be a corpse, and shooting a corpse does not count to first degree murder…

    I still cant figure that out, how can it be pre-meditated and planned when these robbers came in and started shooting? I so got nothing.

    The criminal walked into Mr. Erslands pharmacy to ‘take’, to rob, from him using the threat of harm or death. Mr. Ersland did not walk into the criminal’s home. Had this devil not walked in to ‘that store’, ‘that day’, he would still be alive. He CHOSE to put himself in danger.

    So, the criminal walks in, threatens Mr. Ersland in some way. This is not disputed. Mr. Ersland is fearful for his life, because he had been robbed before and understands the drama he is about to participate in.

    I don’t care if the child criminal was unarmed and alone. The younger and more physically fit criminal threatened the life and property of Mr. Ersland and his employees.

    Mr. Ersland was legally armed, by right of the 2nd amendment, and well within his rights to blow that bastard to Hell with 1 to 185 rounds of whatever was handy until he stopped moving.

    NOW, the criminals’ family is COMPOUNDING THE ORIGINAL CRIME by looking for a huge payday by extorting this man’s life savings and Capital using the Leftist, Racist Court System instead of another relative with or without a gun.

    THE FAMILY needs to be put in prison for continuing a crime started by their idiot relative.

    Case closed.

    I feel no sympathy for this teenage criminal, but from a legal stand point I can understand the issue with this. However, you go into a store with the intention of robbing it, your buddy waves a gun around, you deserve whatever happens to you.       substitute neutralize for eliminated. This is just a legal grammar thing, when discharging a firearm as a civilian, if you are brought into court, your objectives are “Stop the situation from escalating” “Control the situation” “Neutralize the threat”. This is just legal speak, but lawyers like to use grammar to get you into a world of hurt. Words like eliminate and shoot to kill will only give lawyers more fodder.

    I must admit when I saw the headline on this story I wondered how this fellow could be charged with murder for fighting back while being robbed. After watching the video however it was obvious, he goes by the downed robber without a care while chasing the robber who ran out the door he comes back in the store and again passes the incapacitated robber with no apparent concern, goes to the back of the store, comes back and shoots the robber on the floor a second time, don’t know about y’all, but to me that’s murder. I have no problem killing a robber in the commission of an act of robbery, I believe this fellow crossed the line when he took his time picked up another gun and calmly shot the robber who was incapacitated on the floor and killed him. Personally I just don’t understand his reasoning for the second shot, he hit the fellow with a head shot the first time around, it doesn’t seem anything else was needed. If he is acquitted of murder it will cost him a great deal in legal fees and probably his career. :neutral:

And what is he doing running out of the store leaving the two women in the store with a wounded assailant? In my eyes the correct practice would have been a pause at the door and another round or two into the assailant before he left the store chasing the one who got away. Oh and by the way I’ve never heard of a shot in the gut being a way to prevent someone from suffering, not that the robber deserved any mercy.

    I would not vote to convict the guy. However, if you’ve just put a 9mm or a 45 to a guy’s head, he’s down for the count and likely not to live. There is no need to empty your clip into him. I would rather have gone after the other son of a bitch and put one in his head too.

    Obviously, the pharmacist was not military trained. Poor discipline and judgment. But I think he did the right thing by pulling his piece out and fighting back.

      Some one mentioned it was .380 pocket pistol. The .380 is compact and light, but has a relatively short range and less stopping power than other modern pistol cartridges. So fuck the robber who thought it would be okay to pull a gun on him, and the other shitforbrains who came along to rob the guy. Hell I think it would have been better to blast him with 00 buck.

    He’s a combat disabled Desert Storm vet. Scenarios are different in combat and in civilian life and I think he lost sight of that. I certainly don’t want to see him prosecuted, but here in Tennessee, you have to cease and desist once the threat is neutralized (stopped, not necessarily killed. Could be the same in OK, and a prosecutor is always looking for an extra feather in the cap.

      You’re right. I just got more information about the pharmacist on another site. He is indeed a military veteran. He should have double tapped the shots to the head and moved on to get the other guy.

      I guess the DA must be trolling for votes from da ghetto… I think we are going to see more pandering like this during these four years. I never used to think these violent thoughts until fairly recently – just before the election.

      Unfortunately, now the animals are feeling emboldened, especially in cities and states where there is very strict gun control.

    Looks to me like he went back and insured the threat was totally neutralized and then called police. Hard press to get a jury to vote murder in the 1st degree.

    Sat and watched the DA press report – he loaded the story with every incitement he could. Ersland hit the child in the head; passed him on his way out (he didn’t – there was an aisle between them) then came back in and looked at him as he went back to collect his other gun. He checked the women, then went back to check on the robber. No where do you get a full shot of the robber on the floor; did he wake up and start to reach for a weapon in his pack or waist? No one knew he had no weapon until long after he was dead.

    This DA is grandstanding, and I hope that he gets bounced as soon as practicable, and personally sued for defamation and false accusation under color of authority.

    And folks wonder why we RedStaters no longer trust either the cop brass or the inJustice System!

    I’m from Oklahoma originally, and I have no doubt that almost any jury in that state will not convict this man of murder. I do think that he went too far in continuing to shoot when the guy was already down, so maybe some lesser charge may be appropriate. But I am not a lawyer, so I’m just speculating.

      I agree that a properly selected jury will take care of him. The fact that the wounded robber is never in the frame makes it hard to disprove that he still posed a threat – so long as there is a weapon present. First degree murder is vastly overreaching, even if the first shot neutralized the robber. Unless the pharmacist hires the world’s worst lawyer and keeps running his mouth on TV, he has a chance of getting his life back.

    Adrenaline. The pharmacist had an incredible adrenaline surge that literally overwhelmed every other possible thought or function. It wasn’t his fault he was robbed by thugs. They induced the pharmacist’s fight-or-flight biological mechanism. It’s the same thing that causes good cops to kick punks in the head after wild car chases. For a criminals it should be classified as the price of doing business. A good thug is a thug at room temperature. Case closed.
