First of all, if you haven’t joined ACTIVE, please do so immediately.

Notice: If you are new to ACTIVE and in need of letterhead, please send a request to either your immediate superior, or if they have not yet contacted you, then send it to Dina Wilson, the National Printed Materials Officer, via direct message on the ACTIVE website, via this link. The link will only work if you are an ACTIVIST. Her ACTIVE username is Wilson in MA.

One of the missions of ACTIVE is to bring to light and end the transgressions perpetrated, against our Constitution, by the Federal Government. One of the most fundamental concepts of our Constitution is the limitation of power placed on the government by the Constitution. These powers are laid out in Article I, section 8, clauses 1-18 of the Constitution. These powers have been increased without regard to the amendment process laid out in Article V. By increasing the powers of the government, with impunity, the government is now operating well outside their Constitutionally mandated limitations.

There is currently a bill, H.R. 450, that has been referred to the House Subcommittee on the Constitution, Civil Rights, and Civil Liberties. Here this bill sits. The name of the bill is “The Enumerated Powers Act” and was introduced on 9 January, 2009 by Rep. John Shadegg of Arizona. This subcommittee refuses to take any action on this Bill as it would require a change in Chapter 2 of Title 1, U. S. Code to include a new section which would read:

` Sec. 102a. Constitutional authority clause

`Each Act of Congress shall contain a concise and definite statement of the constitutional authority relied upon for the enactment of each portion of that Act. The failure to comply with this section shall give rise to a point of order in either House of Congress. The availability of this point of order does not affect any other available relief.’

This bill would require Congress to inform the American People if the legislation being proposed was Constitutional or not. This bill will die in committee unless the American people require action on this bill. This bill currently has 47 cosponsors and many more are needed. By all rights, if our Congress was willing to uphold their oaths of office this bill should have 434 cosponsors. This is not the case. I am ordering all members of ACTIVE to call and write their elected representatives to demand they cosponsor and vote for this bill. (Write your letter within ACTIVE guidlelines, which is to say, write it with ACTIVE letterhead which is available, via email or real mail, through your immediate superior or the National Printed Materials Officer, Dina Wilson. To understand why it is necessary to write the letter under the ACTIVE imprimatur, read the appropriate guideline on the Rules and Regulations page of the ACTIVE website.) If they do not, we will know the ones that are thumbing their noses at the United States Constitution and their constituents. I will be following the progress of this bill and will be posting the names of those who take their duty as United States Congressman seriously. The current list of cosponsor is:

If your Representative is on this list contact them and thank them for upholding their oaths and defending the Constitution of the United States. If they are not on the list contact them and tell them you want them to cosponsor this bill. This is one thing we can do to get the ball rolling to return the United States to the Constitutional Republic that was envisioned by our Founders. Become ACTIVE!!

Sincerely,

Tim Kerlin

For all Florida residents you can go here to find your Representatives and Senators.

For those in other states, you can probably do an Internet search to locate yours.

Pat, I think the Bill should be ammended… Add to it the EVERY Elected Official is Required to KNOW THE CONSTITUTION !!!
Because I honestly think the people in DC DO NOT know our Founding Document.

    • http://patdollard.com Pat Dollard

      Right on both counts.

    • Lone Wolf

How about requiring them to publish and actually read the bills before voting on them, too.

    • Lone Wolf

Actually, it’s already a rule to publish bills at least three days ahead – a rule written by Thomas Jefferson, no less:

Here’s another bill that got passed in the middle of the night with no floor debate:

    SENATE PASSES HATE BILL!
    YET DEMOCRATS COMPROMISE

    http://www.truthtellers.org/alerts/senatepasshbyetdemocratscomp.htm

“Sen. Patrick Leahy’s hate crimes bill, amending the National Defense Authorization Act, effectively passed the Senate tonight at about eleven o’clock p.m. EDT. A call for cloture, or termination of debate after thirty hours, was passed 63 to 28. Clearly, the Senate majority had spoken. Once cloture is invoked there is usually little more that can be done to resist.

There was no floor debate. A complete end run had been done around adequate Senate hearings, a Mark-up session and Rules Committee debate. Total Senate debate of the hate bill amounted to little more than a brief “kangaroo” hearing in the Senate Judiciary Committee several weeks ago. Witnesses, which included Attorney General Eric Holder were stacked 4 to 2 against conservatives.

Passage occurred despite massive protest from the Christian/conservative right (even more than yesterday) with only the very smallest percentage of calls today in favor of the hate bill.”

I cry with red, white and blue tears.

    • Rick C

I retract my other statement. I read Scoot’s thread on the go and did not realize the Hate Crime bill (I support the 1st amendment not hate) was overturned.

  • dman

I love this. A small but significant step. I just emailed my Congressman and will follow up with a phone call next week!

  • toldyouso

Can’t believe Todd Akin isn’t on that list :?: We will work to remedy that quickly.

  • Rhune

Active needs to put up a billboard with that image on it!!!!

    DO IT!

    • GROUNDWIZARD

that will cost moola, are you willing to donate?

    • Rhune

      yup

  • ji

Being in Illinois, its almost a lost cause.
I will try none the less.

  • Double Tap

    I’ll be calling mine.

One request, however. Can you guys PLEASE stop using this graphic. The supposed Russian word for Change is just plain annoying since it is absolute garbage. (C is an “S” sound, H is an “N”, Д is a “D”, И is an “EE”, G does not even exist as a character, and З is a “Z”) This just makes us look ignorant and only propagates the myth that we are all redneck morons who are too stupid read or speak any language other than English.
