It Has Begun: Alabama May Need National Guard To Stop Unrest As Depression Worsens

BIRMINGHAM, Ala. – The sheriff in Alabama’s most populous county may call for the National Guard to help maintain order, a spokesman said Tuesday, after a judge cleared the way for cuts in the sheriff’s budget and hopes dimmed for a quick end to a budget crisis.

Circuit Judge Joseph L. Boohaker ruled that leaders in Jefferson County — now trying to head off a municipal bankruptcy filing of historic proportions — could go ahead with plans to slash $4.1 million from the budget of Sheriff Mike Hale, who had filed a lawsuit that temporarily blocked spending cuts for his office.

About 1,000 county workers already are on unpaid leave because courts threw out a key county tax, and Hale has warned that reductions to his budget would mean fewer patrols by deputies and decreased courthouse security.

A spokesman for Hale, Randy Christian, said the sheriff told Gov. Bob Riley after the ruling that state assistance may be needed to perform basic law enforcement tasks once the department’s current funding is exhausted in early September.

“We will certainly be looking at calling in the National Guard,” said Christian.

Hale may have to cut as many as 188 deputies and almost 300 civilian workers out of more than 700 employees total because of Boohaker’s ruling, Christian said. That would leave just enough workers to staff the county’s two jails, which hold about 1,000 prisoners on average.

Christian said the department couldn’t close either jail or release inmates, but it would send as many prisoners as possible to the state prison system, which already is badly overcrowded.

Riley previously refused to declare a state of emergency in Jefferson County, which has about 640,000 residents and includes the state’s largest city, Birmingham. But he hasn’t ruled out sending in Guard members or state troopers if needed.

Members of the county’s legislative delegation scheduled a meeting to consider a replacement for the defunct occupational tax. However, Jefferson County Commission president Bettye Fine Collins said she doubted the commission would approve the plan since lawyers already have questioned its constitutionality.

“It wouldn’t make sense to support it since we would likely be right back where we are now,” Collins said in an interview.

The crisis followed court rulings that blocked Jefferson County from using money from an occupational tax that provided some $75 million annually, or about one-third of its budget.

Riley has promised to call a special session as soon as the county’s legislative delegation can agree on a new tax, but prospects for passage are in doubt if Collins and other county commissioners don’t go along.

The budget crisis comes as the county seeks to avoid filing what would be the largest municipal bankruptcy ever over some $3.9 billion in sewer bonds it can no longer afford to repay. As with the tax problem, elected leaders can’t agree on a solution.

The sewer system is still operating normally, but the county has closed four satellite courthouses because of the loss of the revenue from the occupational tax. Residents are standing in line for hours at the main courthouse to do routine business like renewing car tags.

    The only question now is, who are they loyal to, Obama and the Left or the actual Constitution and it’s provisos. Who is leading them and what is their mandate and engagement policies? Can we force them to make them public? We are paying for this “protection”.

      A National Guard volunteer is every bit the American and Patriot we all love and honor. Nothing wrong with the Guard. Take a chill pill.

      Here is my point:

      The troops will need to understand their orders and decide if the commands given are legal with regards to the Constitution. “I was only following orders” will not cut it.

      Since Barry is in office now and is in control of ‘Command and Control’ of those troops, I am questioning the motivation and plan they will put in place to move those troops around:

      Who are they (Command and Control) loyal to, Obama and the Left or the actual Constitution?

      Who is leading them (Command and Control) and what are their rules of engagement?

      Not all Generals are made of the same stuff, and not all love the Constitution. They might believe Barry is correct that the Constitution is a living, breathing FLAWED document and can be bent or broken for the betterment of the collective.

      Can we force them (Command and control) to make them (The rules of engagement in our streets) public?

      After all, we are paying for this “protection”.
      I lived through the LA riots over the years and when the fatigues showed up in the street, big questions arose. If curfew is declared, is it shoot to kill? Is Marshall law on a hair trigger?

      We deserve the facts. That’s what I’m saying, ‘Gaige Mosher’ before you impugn my love and support for the troops and their mission.

      I’m not questioning the Nat’l Guard here. I am questioning the Chicago thugs and the Supreme Leader in DC.

      The post above mine asks interesting questions…if the Guard gets in there and it gets hairy, then what?

      My point is this: Obama is about dividing. He’s about crushing cities and people and states. He wants us to come to him and his government because only they know the way. Only they know the path. Only they can save us morons (like me) from ourselves.

      He’s like a super hero who twists the rails on the tracks, waits for the trains to collide and swoops in to rescue the passengers and play the role of hero. And the sad thing is that in his mind, he didn’t twist the rails, he just swooped in, saved people and basked in the glory. That’s how sick this man is.

    This doesn’t surprise me. I lived in the B’ham for 12 years and the politicians there are as corrupt as they come. The county commission increased the sales tax one year without a populice vote. It was also held up in court, but finally ruled constitutional. Sales tax in that county was 10% two years ago when I moved.

    Correct me if I’m wrong, but isn’t it Unconstitutional to have the military patrolling U.S. cities? Or, are the National Guard not classified as military (To the brave souls serving/served in the National Guard, please forgive me for saying it that way, I didn’t do it to cause harm) due to a bureaucratic decision?

    The talk of the Guard being called out because the County Sheriff might have to choose between cutbacks of courthouse security or prison security is a false choice. In most Red states the judges are packin. ;-)
    Besides, in Cali they just use ‘early release’ of felons. THAT should be reason to call out the guard.

    Oh. And Posse Comitatus is a myth.
