Waxman: Abuse Of Police Powers To Achieve Political Goals Fine By Me

Having served in the Nixon administration at both the Department of Justice and the FBI, I know firsthand what can happen when government officials start using police powers to achieve political and policy objectives. It can lead to a dangerous abuse of power and establish ominous precedents that threaten the civil liberties of every American.

Unfortunately, with House Commerce Committee Chairman Henry Waxman’s recent decision to subpoena 52 of the top insurance companies in the country — which demanded a sweeping array of documents and information (some of which are highly confidential and proprietary) — our government appears to be trying to punish these companies for speaking out on an issue of public interest and importance.

Incredibly, Waxman (D-Calif.) wants more information from these companies — which are not accused of any wrongdoing and have never taken a penny in government bailout money — than he recently demanded from the banking and auto industries that received billions in taxpayer dollars from Uncle Sam.

Considering that we are in the middle of a hotly contested debate about health care reform, it is no secret why Waxman wants these insurance companies to do opposition research on themselves., And nobody should be surprised when Democrats cherry-pick the most damaging subpoenaed information to leak to the media in order to help the party turn the insurance industry into a boogeyman.

As corporate counsel for several trade associations, I have been surprised that this chilling warning shot across the bow of every American who wants to exercise his or her First Amendment rights has not generated a stronger response. Who is next?

Reasonable people can discuss or agree or disagree on the current health care debate, and reasonable people can disagree about the issue of executive compensation. But reasonable people should not disagree about the propriety of using police powers to achieve political objectives. Simply put, the ends do not justify the means under our Constitution (no matter how legitimate the objective may be), and this overreaching subpoena is based on politics — not law.

Imagine, for instance, that a future Republican-controlled Congress decided to enact a series of restrictions on the activities of labor unions and — in order to make its case — subpoenaed documents about salaries, expenses, conferences, events and other activities in order to mine the data for ammunition.

I thought Nixon taught us that we can never mix politics and police powers. In fact, some of us resigned or were fired during the Saturday Night Massacre in order to prove that point.

Regardless of what people think about health care reform or executive compensation, there should be no debate about the government’s use of police powers to stifle debate and retaliate against law-abiding Americans for exercising their First Amendment rights on this (or any other) issue.

That is wrong — regardless of the end objective. In fact, it is a dangerous precedent that the current Democratic leadership will regret in the coming years, when Republicans will inevitably take back control of some future Congress.

    If we have obama-bot DHS, obama-bot feds, or obama-bot locals as neighbors, they need to FEEL us in their faces and know they will be the first.

    We need to make TEA PARTY like statements to ACORN and SEIU that they WILL NOT SURVIVE if Obama-Dems start this.

    Their strategy is to take this country and government so far left that the new middle will become the old left. They are going balls-out full steam ahead with every program and reform that they can do before the pendulum swings back without regards to the economy. They know how difficult it will be for republicans to roll this crap back, especially if the economy makes everyone dependent on the government to survive.

    This is the socialism revolution to transform America, democrats and liberals have bit into it hook-line-and-sinker. The American people at-large have not, so much so that we are the only thing standing in their way. We are the only opposing power and have yet to fully flex our full power. Obama mistakenly believes he has control on our power too, but he doesn’t. He will continue to overreach and that will be his downfall.

    I spent 5 years in the U.S.N. and have 21 years in law enforcement and not a day goes by when I’m not deeply conflicted by my very strong views on the greatness of our Constitution and what seemingly is the daily dismantling of it by Yobama and his socialists cohorts.

    I pray that I’m retired before I’m forced to make a choice in defending the Constitution or enforcing laws that are constantly encroaching on our God given freedoms. The choice will be clear cut but just the same it will be a tragic day.

    This usurper needs to be taken down before our nation burns to the ground.

      That decision has been made for all of us. Unless some divine intervention by a judge disqualifies Soetoro/Obama. Our future was set in stone by the Founders of this great nation. They knew our future because they knew God. The first and second amendments are real. That is what our nation has been about since 1776.

    When will these companies take this to court. We really need to see where this will come down in the court system. Congress has no authority to demand information from private law abiding citizens.

Yes, if the usual ‘politicians’ do the usual ‘politics’, that will always be the argument … that procedure can’t roll anything back. Then it’s time to roll back procedure. The libs want a ‘new world order’? It’s time to give them our version.
