Hasan to Be Charged With 13 Counts of Premeditated Murder in Fort Hood Massacre

Fox News:

DEVELOPING: Army psychiatrist Major Nidal Hasan will be charged with 13 counts of premeditated murder in last week’s Fort Hood mass shootings, a military source told Fox News Thursday.

Hasan, 39, is suspected of killing 13 of his comrades Nov. 5 when he opened fire at a soldier processing center at the Army base in Killeen, Texas.

The American-born military psychiatrist survived the rampage and is being guarded at a hospital in San Antonio. He has been talking to investigators.

Hasan is accused of firing about 100 rounds at unsuspecting fellow soldiers filling out deployment paperwork before civilian police officers shot him and stopped the attack.

The massacre killed 13 people and left about 30 others wounded. It has been classified as the worst mass shooting on an American military base.

Hasan’s motives are being investigated.

Reports have surfaced about possible communications he may have had with terrorist groups, fear of his imminent deployment to the war in Afghanistan and potential psychiatric problems, but

    So that’s it? Murder? With all that is known and yet to be discovered, they’re white-washing this terrorist attack into nothing more than “work-place murder.”

    People will not stand for this.

      Hopefully this is just a procedural charge to charge him with something within a timeframe, and the real/additional charges will be announced after investigation.

    I’m a little rusty on the UCMJ, but in my day, we would have charge Hasan with the following Articles:
    80 – Attempts – as attempted murder, 31 counts
    81 – Conspiracy – for contacting radicals prior to the act
    89 – Disrespect toward Superior Commissioned Officer – for any senior officer that may have been in the line of fire
    90 – Assault on a Superior Commissioned Officer – for any senior officer that may have been in the line of fire
    92 – Failure to obey a lawful order – for failing to stop when ordered to do so
    93 – Cruelty – both mental and physical, one count for everyone present at the time of the attack
    94 – Mutiny – Fairly obvious
    95 – Resisting arrest – had to be shot to get him to stop
    104 – Aiding the Enemy – includes any contact or communication with the enemy, one count for each conversation
    106 – Espionage – ditto above
    108 – Damage of Military property – one count for every service member shot, plus buildings and any other damage done
    116 – Riot or breech of peace – For the chaos at the shooting scene
    117 – Provoking speech or gestures – ALAHU AKBAR before & during the shooting
    118 – Murder – 13 counts
    124 – Maiming – 54 counts
    128 – Assault – 54 counts (plus additional counts for anyone present even if they weren’t shot)
    133 – Conduct unbecoming an officer and a gentleman – Fairly obvious
    134 – General Article – For action not condusive to good order and discipline

    He should be convicted by a General Court Martial on all counts, then hung.

      And as Nanny said, I too was wondering why only 13 and not 14 including the unborn child.

      I’m thinking feet-first through a woodchipper might be more suiting for this murdering traitor piglet.

      Sorry, all. I forgot that one of the victims was pregnant. 14 counts of murder, 55 counts of maiming and 55+ counts of assault.

    His execution should be made available on pay-per-view with all proceeds going to his victims.

    I’d rather he be tried in Texas State Courts – we know they execute murderers!

    They missed a murder charge – should be 14 as one of his victims was pregnant. I believe there was a law passed a couple years ago in memory of Lacy Peterson that says a person can be charged with murder in the death of an unborn child if it is pre-meditated.
