    Not only is that NYT piece lying when it says ‘rate regulation is not a feature of the current bill’ (it very much is), the SCOTUS has already slapped down rate regulation schemes in non-monopoly situations (like health insurance).
    Dusquene Light Co. v. Barasch, I believe.
    I can’t find the bookmark but Prof. Richard Epstein of the Univ. Of Chicago wrote a constitutional analysis of this aspect of health control at pointoflaw.com a while ago.

    Barry’s ‘end game’ strategy is a fight with the present SCOTUS that He believes He will win. He has already made His disdain for SCOTUS and The Constitution overly clear.
