House Majority Leader Steny Hoyer is warning that some of his Democratic colleagues are being threatened with violence when they go back to their districts — and he wants Republicans to stand up and condemn the threats.

The Maryland Democrat said more than 10 House Democrats have reported incidents of threats or other forms of harassment about their support of the highly divisive health insurance overhaul vote. Hoyer emphasized that he didn’t have a specific number of threats and that was just an estimate.

TheFederal Bureau of Investigation, Capitol Police and sergeant at arms briefed Democrats behind closed doors today about the incidents of violence — the most high profile of which have been toward Democratic Reps. Thomas Perriello of Virginia, Steve Driehaus of Ohio and Louise Slaughter of New York.

Hoyer hinted that Republicans should do more to condemn these threats of violence.

“I would hope that we would join together jointly and make it very clear that none of us condone this kind of activity,” Hoyer told reporters. “And when we see it, we speak out strongly in opposition to it. And I would hope that we would do that going forward.”

Rep. Jim Clyburn (D-S.C.), the majority whip, said Democrats and Republicans should continue to speak out on these threats. “Silence gives consent,” Clyburn said.

But Minority Leader John Boehner already has condemned threats of violence — and sought to explain why people are so angry.

“I know many Americans are angry over this health care bill, and that Washington Democrats just aren’t listening,” Boehner said. “But, as I’ve said, violence and threats are unacceptable. That’s not the American way. We need to take that anger and channel it into positive change. Call your congressman, go out and register people to vote, go volunteer on a political campaign, make your voice heard — but let’s do it the right way.”

A Republican aide also pointed out that over the years Republican members of Congress received their fair share of death threats during volatile times. Newt Gingrich after the 1994 Republican revolution and the late Henry Hyde during the Clinton impeachment in 1998 both received numerous death threats. And just last month, Sen. Jim Bunning (R-Ky.) received death threats after his filibuster of unemployment benefits, according to a report in Roll Call.

Hoyer said steps are being taken to protect members of Congress. Most lawmakers do not have formal security protection, but if any member feels threatened, they will be getting “attention from the proper authorities.”

On Wednesday, the FBI began a preliminary investigation into fuel lines cut at the Virginia home of Perriello’s brother, whose address was posted online — the poster thought it was the lawmaker’s address.

Driehaus said his address was posted Wednesday on a right-leaning blog.

      There are those who make the argument that there is no role for the military in opposing civic authorities. They make the argument by stating the military has no power to act constitutionally because all such power flows through the ‘conduit’ of civic authority. That is, that the military can only do what the civic authority tells it to. Further, the argument states that military action to intervene would amount to a junta and therefore be considered treason. With this argument I would agree, with the following caveat:

      That the civic authorities act constitutionally.

      Now then, if the civic authorities act unconstitutionally does this mean the military must remain under their control, or remain neutral, or simply sit on their hands? If this be true, then, the unconstitutional acts of the civil government could continue until the people are slaves to the whim of the regime as the military, by its act of omission, implies consent to the unlawful acts. And in this the people would be in fear of forming an organized resistance. For by this assertion the people’s resistance would not be considered patriotism, but insurrection against which the unlawful authorities would order the military to act.

      I argue that once the civic authorities act unconstitutionally, they can no longer claim its protections. Further, the military and the people are free, and in fact duty bound, to remove the offenders from office and hold power until such time as the constitution can be restored.

      If I am wrong then the civic authorities are King. Because there are no circumstances under which the military can intervene and acts of resistance shall be deemed insurrection. If I am right, then the military must openly stand with the people, NOW! before such time as a private army is established and further acts of despotism are made law.

      I close with this:

      Does the constitution protect its own destruction?

      If so, then us quietly assume the chains of slavery. If not, then let the military leadership step forward with patriotic Americans and put an end to this unconstitutional socialist take-over now.

      It is the duty of military members to refuse to obey unlawful orders. Unlawful orders are, in simple terms, orders that do not support and defend the Constitution. It is up to each individual member of the military to determine if an order is unlawful, and you have to be ready to take the consequences of disobeying. But it’s your duty to disobey unlawful orders.

      Additionally, all military members are sworn to support and defend the Constitution against all enemies, foreign and domestic. So I see two factors that *require* the military to act against civil authority when that authority is acting against the Constitution.

      Thing is, 99.999% of the time, it’s not really an issue. But there’s those rare cases where some commander is stupid or crazy, and you have to make your own judgment call.

      If you make the wrong call and obey an unlawful order, you can be prosecuted. “I was just following orders” doesn’t cut it. If you make the wrong call by disobeying what you think is an unlawful order, you can also be prosecuted. Either way, you will probably face a court-marshal.

      You gotta be really sure, and you gotta have some serious sack, if you’re going to disobey an order.

      Sully: When you join the military, you take a risk that you may have to put your life on the line. You might die, you might be severely injured, and it’s possible you might be imprisoned even if you thought you were doing the right thing. You might be imprisoned as a POW, or you might be imprisoned as the result of a court-marshal for disobeying an order.

      There are no guarantees, there are no foolproof checklists, sometimes you just have to use your best judgement. Life is risky, but when you are in the military you increase the risk. Fortunately, these kind of difficult situations are rare.

My logic is that at some point sovereignty lies with the people and that it is their duty to preserve it. I further argue that at the same point the military obligation is to stand with the people to preserve the republic. The ‘framework’ is being destroyed from within with purposeful intent. We shall see if SCOTUS takes the case. In the meantime, as gentlemen, we may simply disagree.

      My question is how can anyone claim to be defending the Constitution and the rule of law when the Federal Judiciary and SCOTUS, a co-equal branch, got the first complaint yesterday.
      I haven’t read the State complaint yet but I can tell you their suits are the first of many to come. ObamaScare is in deep shit when a corporation (like Caterpillar) gains standing. same for doctors, hospitals and insurance companies.

      I suppose another point worth making is that the legal process will also flush out other enemies of liberty that we might not yet anticipate.

      In any event, the best shot we have (short term) of neutering this nationalization clusterfuck is in November.

      I believe that the first three have failed! If someone can prove me wrong…so be it…but I do not think that they can. With the preponderance of the readily available evidence, it is quite easy to say that the soaop box is out, the ballot box has failed, and the jury box has been stacked against us. When over 60 percent of the people voice strong opposition, and that opposition voiced quite publicly for months and months, the government is not only not listening, but does not plan to listen in the future. The only box left is the cartidge box and the only question remaining is: will that box be put to use for us or against us.

      In answer to your query of the first instance: The constitution was not written for an elite. It was written to be understood and comprehended by the common citizen. Therefore, I can say with justification and good reason that opposition to socialism is a defense of the Constitution. And further, that an attempt to subject American citizens, incrementally or otherwise, to socialism is unConstitutional.
      Now, what will you do if SCOTUS confirms the bill and rules socialism Constitutional?

      At this point I find the question you pose a highly unlikely scenario. But were it to come to be, THEN open revolt would be warranted and likely.
      And I have taken rather extensive personal steps to protect life, liberty and property.
      And while I do agree that the Constitution is plainly written, that does not hold for 200+ years of U.S. Code which I think you’ll agree is commonly referred to as ‘rule of law’ and what any suit has to contend.
      I believe that civil unrest in the form of active non-violent disobedience can show SCOTUS and others the ‘political will’ of the people sufficient to help them decide to overturn this legislative travesty.

      As an aside, that belief probably works against my self-interest in that I may have alot of excessive ‘firepower’ around here.

      Sully-It is my personal contention that there have been numerous and grievious constitutional violations by this traitorous administration since it was elected and thrust onto the political scene. Obama has indicated that he intends to follow a globalist agenda regardless of the American people’s will. One example is the by-passing of Congress, in reference to the regulation of carbon dioxide gas and the placing of that issue into the hands of his Evironment Protection Agency or the usurping of control over fishing in American waterways and the threat to end all fishing, in certain areas, under the United Nations water management agency and the National Oceanic and Atmospheric Administration.

      How many more times must we wait before we, Patriotic Americans, begin to make decisions about this Country’s future?

      With the last 50 years of liberal bench loading of the courts, we have few friends there. We have been on our soap boxes for years on end. The ballot box holds no guarantee of victory and no guarantee that those who win will be honest enough to fulfill their promises.

      Only the catridge box remains…and as Washington stood and looked across the landscape of Valley Forge, so we stand today with the same quandry…we are outnumbered, outgunned, outmanned, and would certainly be outspent, but we are on the side of right and we must proceed regardless of the loss or the cost…America is worth it all!

      Alito, Roberts, Thomas and Scalia were what exactly? Elections have consequences.

      I think we have a very good chance to overturn ObamaCare in the SCOTUS and perhaps even the next election.

      Sully … if the SCOTUS doesn’t do it, it won’t be repealed through the federal government. There just isn’t enough seats to win in November to have a veto proof Congress. The Republicans should make very good gains if the attack on the reputation of the Tea Party is not smeared and we can keep the spotlight on how very bad this law actually is (shouldn’t be hard especially with that ‘pesky’ 300B doctor payoff looming for the Dems to try to fund).

      That said, if the SCOTUS doesn’t do it, the last chance is the state legislations with Article V or the 10A.

      I’m very much in favor of and active toward returning State powers.
      I’m not sold on Constitutional Convention though.

      I have been watching the court system and listening to people on their “soap box” for decades…what do you mean “Who has been on their soap box?” I have been speaking to large groups publicly for more than 23 years and have listened to such speakers for my entire life!

      With attitudes of wait and wait and wait and wait and wait and wait and even wait longer on the courts, and most descisions in this nation are made in the lower courts and never see the light of day at the SCOTUS, we have been waiting for over 50 years! The Warren and Burger Courts did unfixable damage to this nation under the guise of being “Conservatives.”

      In many ways we may have waited to long to respond…

      So, yes, I think we are at the cartidge box stage…regardless of whether you believe that is emotion or not, is irrelevent to me…not all emotion is wrong and unwarranted.

      When I hear the Nation Anthem and cold chills run down my spine…that is emotion!

      When I watch Old Glory wave in the breeze against a bright blue sky and my hear is moved to tears…that is emotion.

      When I stood in front of the casket of my oldest son, killed in action in Fallujah, Iraq and wanted to pull the head off of those who took his life…that is emotion.

      When I see and hear liberal politicians destroy our current freedoms, shred our Constitution, threaten our capitalistic way of life, and promise to replace it with socialism. That causes me to be emotional…those emotions are not wrong and certainly not unwarranted.

      And when pin-heads seek only to talk about such issues, offer no realistic alternatives, and seek only to set on their every widening tail ends, would not lift a hand to fight for this nation or to protect any of its citizens, or fight to protect our freedoms as a nation. Well that causes me to be emotional too. It makes me want to grab them by the throat and twist their beedie little heads off!

      But…I’m just sayin…that’s emotion! And that emotion kept men alive in fox holes, kept the flame of revolution alive when all seemed lost, kept expolers who grew this nation from quitting, and keeps men like me from ever surrendering America to the likes of Obama and his cronies.

      Yes Sir…I am emotional! And everyone that threatens this Nation and her citizens needs to keep that in mind and also understand that I am not alone!

    This is not really the end of the story but rather hopefully the beginning of a new chapter in the history of the United States of America.

    I hope with instant communications and the benefits of capitalism and the free market that we will return to our first national government, The Articles of Confederation. In any case, I have confidence in the American people making the best decision for freedom, liberty and limited government once the present chains of control and theft are removed from our nation and people. This is my hope and daily prayer!
