AUSTIN – State Rep. Leo Berman, R-Tyler, will introduce immigration legislation comparable to a law recently enacted in Arizona, according to an aide.

Rep. Berman, who is traveling in Europe, authorized the aide to respond to KVUE News’ request for information regarding his plans for the 82nd Legislative Session which begins in January 2011.

According to the aide, Berman said his bill will be similar to the Arizona law, specifically the provision which requires local law enforcement agencies in the state to check the immigration status of individuals who they suspect of being in the United States illegally.

While the bill is expected to look a lot like the Arizona law, at least one group of Texas lawmakers notes that the Texas Legislature is very different that the Arizona Legislature.

State Rep. Solomon Ortiz, D-Corpus Christi, serves as the treasurer of the Mexican American Legislative caucus and said Berman’s bill will face a very different political reality here in Texas.

“The public that knows Leo will know this isn’t the first time he’s filed related or similar legislation,” he said. “The Mexican American Legislative Caucus is almost a third of the Texas House, so the prospects of something like this passing the Texas House is very slim.”

Ortiz’ prediction doesn’t please Texas voters like Kelly Clark who grew up in Arizona and now lives in Leander.

“I’m an American. I pay taxes. I want people to know if there is somebody here that’s going to get paid to, basically, take money out of my mouth,” he said.

Clark dismissed worries over possibly requiring local Texas law enforcement agencies to enforce federal immigration statutes.
“I think law enforcement should be upholding all of it,” he said. “I don’t think the law should change from one location to another.”

Other Texas voters, including Shakshi Kshatriya, a Houston-native who now lives in Austin, worry such a law would lead to racial profiling and violates the U.S. Constitution.

“It really is just letting police pull over whomever they think is illegal and, actually, when you think about it, that is an outrage,” she said. “We have all these different, diverse groups of people. That’s going to be an insult on their own integrity.”

The two leading candidates for Texas governor – incumbent Republican Rick Perry and Democrat Bill White, the former mayor of Houston – have declined to say if they would sign or veto such legislation if it ever reached their desk.

Whatever the fate of Berman’s bill, lawmakers including Ortiz expect a fight over the legislation, especially as worries continue to simmer along the border, that cartel drug violence in Mexico will spill into Texas.

“Nobody wants to see that happen, obviously, but the federal government obviously has an obligation to enforce federal laws and enforce immigration policy,” Ortiz said.

    We don’t need a new law that allows for enforcing an old law. “Illegal” aliens are breaking immigration laws. Seal the border, enforce the law, and send the illegal’s back where they came from.

    Anyone who opposes bills that allow state, county and city LEOs to check immigration status and deport illegal immigrants, is doing nothing but supporting and encouraging the breaking of US Federal Immigration laws. In other words, all these people want “special priviledges” for illegal immigrants, (i.e. immunity from a Federal crime). It’s interesting that very few legal Americans had a problem with the Border Patrol setting up checkpoints and checking everyone. However, now the Mexican community is claiming this is racist. If you are here legally, then you have nothing to worry about. If you are breaking no crime, then you have nothing to worry about. Only those opposing state immigration laws are worried that illegals will be deported, wanting them to stay in the United States illegally. The Feds aren’t willing to enforce illegal immigration laws, so not its up to the state to protect itself. Anyone who opposes state immigration laws SHOULD BE VOTED OUT IMMEDIATELY.

While stopped at a stop light this past weekend, there was a Hispanic Family of 21 crossing in the crosswalk in front of my vehicle. It was obvious these folks were illegals..I just shook my head in amazement.They all looked at me and they could tell my displeasure. I thought how did you people get into my country???     There is absolutely no legitimate argument against AZ’s bill – it does not permit stopping people for simply suspecting they are illegal – there must be just cause for ANOTHER crime or emergency prior to requesting ID, it does not single out any particular ethnicity, it is already a federal crime to be in the country illegally. It is already federally mandated that immigrats keep their papers on their body. Citizens are expected to have some sort of identification on their persons at any given time. This bill simply forces law enforcement to ENFORCE THE LAW!

In Mexico, people can make citizen arrests of people they suspect are illegal immigrants, and upon arrest, it is considered a FELONY with a MANDATORY 2 years in prison.       Yes, Historically our forefathers who founded this Country were immigrants. They desired religious independence, and freedom. What they created was a Constitutional form of Government on the basis that all men are created equal. Now saying that, one of our fundamental roles under the US Constitution is to protect us from our enemies and the securing of our borders Period. Founded in the preamble of the Constitution of the United States for our Government to provide for a common defense, that includes foreigners from Mexico and other Countries invading the United States Of America. Illegals from Mexico and other countries are violating the Constitution and thus are breaking the law. Those people are not entitled to come here on our soil looking for health care, a job, to send money back to Mexico. Immigrants in years past came to this Country to become Americans. That means SPEAK AND READ ENGLISH as part of the total assimilation into American culture. Not the Mexican culture. That means obeying American laws. What Texas is doing is Constitutional. Americans will do the jobs AMERICANS USED TO DO and still would if illegals were not taking those jobs. Big business is partly to blame for paying low wages to illegals. Now, our National Unemployment rate hovers around 9-16% the Obama regime will not stipulate to real facts. When we have a President who undermines our economy intentionally, our citizens have lost the motivation seeking work.     While “all our ancestors were immigrants” (except for those of us whose ancestors were Native Americans)since the USA became a nation, most all of those immigrants came here through LEGAL process. I’m NOT anti-immigrant. If you want to be an American, you must respect America and her laws. Mexico demands visitors do the same, with a mandatory 2-year prison sentence for illegals.
    As to the anchor baby issue, the babies have not done anything, and certain comments above were out of line. But would the non-citizen mothers prefer their citizen children to stay here in foster care, or to go back home with them to their country of origin? As a parent, I would chose the latter. Then again, I wouldn’t place my child in such a situation by my own actions, either.
    It is our business to insist those coming here do so legally. Entering and staying in a sovereign country in defiance of it’s immigration laws IS breaking the law. Because we are a nation of the people, by the people and for the people, a nation based on equal treatment under the law. EACH of us has a responsibility to hold our government accountable for its actions. Or, case in point, its inactions. We can’t cherry-pick which laws we are to obey and ignore the rest of them.
    The problems caused by illegal immigration affect ALL of us: municipalities and states that bear financial burden; taxpayers who fund social programs; immigrant him/herself who often must allow themselves to be little more than slaves.
    As for the “doing the jobs you stuck up people won’t do,” ask any hard-working construction laborer what happened to the job market and wages when illegal workers started driving down the price. With skyrocketing unemployment, I’m sure some American can do the job.

    I had a doctor’s appointment at the local VA clinic yesterday
    and found something very interesting I would like to pass along. While
    going through triage before seeing the doctor, I was asked at the end of
    the exam, three questions.

    (1.) Did I feel stressed?
    (2.) Did I feel threatened?
    (3.) Did I feel like doing harm to someone?

    The nurse then informed me that if I had answered “yes” to any
    of the questions, I would have lost my concealed carry permit as it
    would have gone into my medical records, and the VA would have reported it to Homeland Security.

    I am a Viet Nam vet and 15 year cc permit holder. Looks like
    they are going after us “vets.” Be forewarned and be aware. The Obama administration has gone on record as considering veterans and gun owners as potential terrorists. If you are a veteran, you’ve been warned. If you know veterans, please pass this on to them.

    Arizona’s proposed anchor baby law may actually pass the Constitutionality test. The Constitution states anyone born in the US is a citizen BUT the person must be “subject to the jurisdiction” of the United States. One could argue that illegals are outside of this jurisdiction.
