In its second major ruling on gun rights in three years, the Supreme Court Monday extended the federally protected right to keep and bear arms to all 50 states. The decision will be hailed by gun rights advocates and comes over the opposition of gun control groups, the city of Chicago and four justices.

Justice Samuel Alito wrote for the five justice majority saying “the right to keep and bear arms must be regarded as a substantive guarantee, not a prohibition that could be ignored so long as the States legislated in an evenhanded manner.”

The ruling builds upon the Court’s 2008 decision in D.C. v. Heller that invalidated the handgun ban in the nation’s capital. More importantly, that decision held that the Second Amendment right to keep and bear arms was a right the Founders specifically delegated to individuals. The justices affirmed that decision and extended its reach to the 50 states. Today’s ruling also invalidates Chicago’s handgun ban.

In another dramatic victory for firearm owners, the Supreme Court has ruled unconstitutional Chicago, Illinois’ 28-year-old strict ban on handgun ownership, a potentially far-reaching case over the ability of state and local governments to enforce limits on weapons.

A conservative majority of justices on Monday reiterated its two-year-old conclusion the Constitution gives individuals equal or greater power than states on the issue of possession of certain firearms for self-protection.

The court, however, said local jurisdictions still retain the flexibility to preserve some “reasonable” gun control measures currently in place nationwide.

    Well no, that’s not correct.
    The Supreme Court didn’t “extend” anything. The court just affirmed what the Constitution has always said. We have the right to protect ourselves from our own government.

      :arrow: uclimbit, are you serious? Yes, in the America we live in it should have been unanimous (9-0), but, unfortunately, there are justices on the court who live in utopian fantasies. I have a .pdf of the entire ruling, and in his concurrance with Justice Alito’s “Opinion of the Court”, Justice Scalia delivered a rather scathing dissection of Justice Steven’s dissent. Read that and you will know why it was a 5 to 4 ruling.

      That’s incorrect, the Constitution reaffirms what was declared in The Declaration of Independence :arrow: “We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness”.

      The Constitution wasn’t giving anyone any rights. The founding Fathers were simply affirming our God given rights that they enumerated in the Declaration of Independence.

      PS – take a long, careful read of the Declaration Of Independence, specifically the charges against King George, not only is it an eye opener towards America’s character, but also today’s current events.

This ain’t the last of the Second Amendment controversy (which, how can it be controversial if it’s IN THE BILL OF RIGHTS, I have no idea) … but liberals are going to keep pushing this until they get what they want. That’s why a ‘win being a win’ isn’t good enough. When something as blatant as:

      “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

      is questioned, simply winning by 5-4 is not enough.

    ‘Stevens, in his final day on the bench after more than 34 years, said that unlike the Washington case, Monday’s decision “could prove far more destructive – quite literally – to our nation’s communities and to our constitutional structure.”‘

    What Stevens is saying is that this 5-4 ruling is going to be destructive and detrimental to the Socialist movement afoot in this country. Socialism only works when you have a non-thinking and defenseless population who are held in slavery by a totalitarian government.

    A 5-4 decision is a very narrow margin of victory. This country can’t afford any more Supreme deaths or retirements of the 5 who voted with the Constitution. Just one more death or retirement while the Soros Ass Puppet is in the Brown House and we are all fucked!

      During her confirmation hearings, Sotomayor said that she respected the Second Amendment, but voted with the minority. What conclusions can we draw from this?       There is no law written that can take precedence over or replace the Constitution. If they want to make changes it has to be done through the Amendment process and none of the meat whistles in DC want to do that.

      Your right to own and carry a firearm is the 2nd Amendment. Gun laws are secondary to that.

    Will this ruling affect prior federal firearms legislation?

    Imho, any type of excessive tax on ‘any’ firearm or accessory, is akin to a poll tax & it infringes upon the very right that was just confirmed as inherit. As well, the proctological exam required by the ATF when going class 3, is just too much of an invasion for many to submit to.

    Self-preservation from the relentless tentacles of a voracious government, is the preeminent reason for the 2nd Amendment, & sometimes that self-preservation calls for some serious rock & roll.

    Protection from criminals is only a secondary benefit, hyped as if it were the foundational reasoning behind the 2nd Amendment. Pure dissimulative crap.

    I won’t be happy until all un-Constitutional guns laws are overturned.
