      It seems to me that Smith argued a certain point counter to Judge Napolitano, admittedly with feeling, and the Judge responded well. That’s a good way of laying out the issue. Well done Fox.

      Did anyone seeing that have difficulty making up their own mind. Does America want to be fed what it should believe? That’s what communism offers.

      Smith was wrong, he missed the central problem… but it got revealed for those interested:

      The government dictates options for which it has no liability and the oil company complies without liability or insurance based on government regulation.

      The Government restriction to drill at 5000ft was wrong.
      The Government offer of a liability limit was wrong.

      What about the expert oilmen? What of BP? What of this company, BP, with 97% of the industry safety violations?

      Were BP right to lobby for limited liability and then not take out insurance?
      Did they really think that would wash with the public?
      Did they really think the company reputation was worth so little?

      When the Government told them to drill in 5000ft of water were they right to do it?
      Chevron say they walk away when the project is dangerous.
      BP engineers called this a nightmare well.

      Bearing in mind they had no insurance on a nightmare well were BP right not only to go ahead, in what they considered to be the WRONG place, and then to cut corners on best safety practise multiple times in order to save a little money?

      And bearing in mind that the company chose to do this were they right to take those risks with the company’s future and its reputation?

      From their actions it appears that no other company in the industry agrees.

      Let me put it this way: when the officials encourage racing drivers to race on dangerous tracks in dangerous conditions they refuse. That’s why we consider them professionals.

      BP, with 97% of the industry’s safety violations, have shown themselves to be amateurs. They should fall.

      As for the government the solution isn’t no regulation and it isn’t no liability.

      The solution is limited regulation, where essential to maintain honesty and a level playing field and unlimited liability.

      Unfortunately our Democracy has been corrupted by lobbying for a total lack of policing of white collar crime and zero liability.

      The zero accountability $700 billion bank bailout is a perfect example of that.

      The Tea Party needs to rip through all elections removing the parasites from the tit of the Treasury.

      The Brazilians have a joke about any badly run organisation being robbed from all sides… they call it a cow with twenty teats. Well that’s what our government has become and don’t make any mistake… many of those teats are occupied by pseudo-Republicans.

      Those arguing for no regulation at all, no banking accountability, no active SEC, no functioning FDA, no concern for the environment, bailouts for incompetent companies and, in fact, no basic standards at all are arguing for an American cow that gets sucked dry leaving our kids to struggle with the consequences.

      Under the guise of liberal trade they would corrupt our way of life and turn America into a South American style banana republic.

      Small government means no bailouts… NONE.
