Dashcam Video: Florida Highway Patrolman Tases Handcuffed Girl Causing Her To Now Be Brain Dead

Feb 16, 2012 23 Comments ›› Pat Dollard

Let’s face facts. Regardless of the circumstances of this case, WAY too many cops are a bunch of fuckin’ pansy fags, or straight dipshits, overreaching for their tasers for a variety of stupid reasons, including but not limited to, “I’m gay and I’m scared”, “I personally don’t like you cos you personally pissed me off”, and “Tasing people is fun” (which it is, but you gotta be careful with this shit). When tasing, it’s important to remember that the taser will cause the body to drop, not rise and levitate safely a few feet above the ground until someone takes possession of it.

Liveleak:

The Florida Highway Patrol have cleared 267-pound Trooper Daniel Cole of wrongdoing and have released a disturbing dash cam video that captured him tasing a 100 pound, 20 year old handcuffed girl in the back as she fled.

The Florida Department of Law Enforcement determined Trooper Daniel Cole’s “use of force” was justified when he tased the woman last September at the FHP Pinellas Park Substation and cleared him of wrongdoing.

The fleeing woman, Danielle Maudsley, 20, suffered severe brain damage after hitting her head on the concrete and has been in a persistent vegetative state ever since.

The video shows Maudsley fleeing a back door of the substation with Cole following closely behind.

Maudsley was arrested for her alleged involvement in two hit-and-run crashes and driving without a license.

Cole brought Maudsley to the substation to complete his paperwork before taking her to the Pinellas County Jail, according to FHP reports.

As she enters the parking lot, Cole deploys his taser and Maudsley hits the ground hard, with her head slamming into the asphalt.

“What were you thinking? What are you, stupid?,” Cole can be heard asking Maudsley on the video.

“I can’t get up,” said Maudsley.

“I don’t want you to get up,” said Cole.

“I can’t get up,” Maudsley said again. The last words Maudsley has spoken since being tasered.

On the video, Maudsley loses consciousness about two minutes after hitting her head.

Maudsley’s mother said the trooper should have used other means to stop her daughter from fleeing.

“He was right behind her. He could’ve reached out,” Maudsley said. “It was unnecessary.”

The mother hired defense attorney Kevin Haylsett, who put FHP on notice for a lawsuit.

Hayslett said Cole violated FHP’s taser policy which states:

“Fleeing cannot be the sole reason for the deployment.”

“When you shoot someone in the back, and they’re running away, all that force — as you saw when Danielle’s head hit the concrete — that’s why they don’t allow you to do that, because you can have horrible tragedies like this,” Hayslett said.

With any rule, there is an exception.

An Office of Inspector General Investigation Unit report states: “Although the FHP policy on Electronic Control Devices states that a member should not use the device on a handcuffed prisoner, it also provides that there may be situations that conflict with this policy.”

The report goes on to state: “In this situation, Maudsley … removed one of her handcuffs while in the back of Cole’s patrol car, and moved her handcuffs from behind her back, to in front of her body, as she attempted to flee the FHP Station. In addition, Maudsley was running towards US Highway 19 which is a high volume road.”

According to the report, Maudsley had oxycodone and cocaine in her system at the time.

“The Florida Department of Law Enforcement conducted an independent review of the incident,” FHP spokesperson Sgt. Steve Gaskins said. “Their investigation found that the trooper’s actions were legal and within the scope of his duties.”

“He would’ve been better off to use his nightstick on her than he would a taser,” Hayslett said.

The attorney also pointed out that Maudsley only weighs about 100 pounds.

In the report, Cole said he chose to use the taser because he “felt she was more susceptible to being injured if he attempted to tackle her.” Cole weighs approximately 267 pounds.

Hayslett called the dash cam video disturbing. “It’s one of those videos — when you see it and you watch her head hit the pavement — that it’s hard to get those images out of your head,” he said.

Maudsley’s mom said her daughter’s prognosis is not good. She is likely to remain in a vegetative state.

Maudsley is now in a Ft. Lauderdale rehab center that specializes in severe brain injuries.

sue the crap out of them, fire the prick

Good lord SHE IS HANDCUFFED, She ran, he could have out ran he and caught up with her. I know the sayin’” work smarter not harder” but this is over the top. The academy’s don’t teach cops to be police anymore, they rely too much on taser’s,mace,pr 24′s, i do understand were the cops are coming from dealing with threats on every call they go on. they call it foot persuit for a reason. I agree sue the the HP.!

    • Kelty

I am sorry but I completely disagree. It sucks that this young girls life has been wasted however hopefully it teaches other people not to be stupid and run from the police. Did you read the article?? She was on drugs and left the scene of two accidents and did not have a drivers licence. So do you think everytime a criminal runs, the police should just let them go???  And lets say, he did “tackle” her instead of tase her and she hit her head. You would then be saying, why did he tackle her?  He was 250 lbs!   Stop blaming the police for peoples bad decisions.

    • Kelbo7

And if you search her name, this isn’t her first arrest.  She has 3 arrests that show up in Google for burglary and grand theft.  Not exactly a sweet, innocent girl who was running away.

    • James Sanchez

she removed her handcuffs. i saw a picture captured from a surveillance video, where the handcuff was on her left hand only.

  • WTF

If I were her Dad, that dude would soon be joing her in eternal rest. That dude could have easily grabbed her w/o risk to himself. Sure the girl should’nt have run but no way she was going to get away. The guy probably needs to lose 60 lbs but instead relys on the taser to do what he is not capable of.

What a waste of a life. The girl should have done the time for her hit/runs or whatnot but to die because your arresting cop is a fatass, raw deal..

  • lube

that fat ass could not have run here down if she had been hog-tied. and it is abuse of power because he should not have had to taser her because he is to fat to run

  • badgirlpinto

Of course the cop had to use his taser,  he’s so fat he couldn’t even chase a three year old and catch him.  Are there no physical fitness guidelines to qualify for or keep a law enforcement job?

  • Chrissie

Bottom line: If she wouln’t have run, she wouldn’t have been injured!!!!

  • Icorps1970

If someone is stupid enough to run from the cops when HANDCUFFED maybe she needs to be a out the gene pool.
She screwed herself up and now the family wants to blame someone else.

    • Giorgi

even the Geneva Convention gives POWs a right to an escape. what do you mean? and this is not a warzone. young aduld made some mistakes, and pretty sure she would pay for them. putting her into coma is not what I would u call a punishment deserved. maybe a broken leg. or a rib. thats about as far as I would go.

    • TomLikesGuitar

So how do u suggest that we break her leg?

It was a freak accident, it’s not like the cop WANTED to put her in a coma. The point is just that he really isn’t to blame.

  • Giorgi

he was right behind her. i got a lot of respect for cops, but often on u get one of them powertrippin assholes who ruin it for everybody else, and make up reasons/excuses to use “less-than-lethal” force. what kind of lame excuse was “i could have crushed her under my 250lb wheight”. well dont jump on her, grab her hand and twist it into submition. dont they teach martial arts moves in academies, like pressure points?

  • Macsplusmore

SOB. OUT OF SHAPE ASSHOLE. HE DIDN’T EVEN TRY TO GRAB HER.

  • http://twitter.com/DANEgerus DANEgerus

If officer fat ass had grabbed her he would have been sued for excessive force for that instead. Bottom line? “two hit-and-run crashes and driving without a license”?  Play with fire and get tased into vegetative state.

    • James Sanchez

and she was on oxycodone and cocaine. she had previous arrests for drugs and burglary

  • obeythelaw

I am so sick of criminals getting hurt and then crying about it!!!!!!  If you follow the laws you do not put yourself in these situations. Police get paid very little and put there lives on the line everyday for us and then have to put up with people who get on them about how they do there job.  Can we please stop standing up for the people who break the laws and start backing our officers!!!  Maybe the girl is now in a vegetative state because of the drugs she had been taking!!!

  • ColdSoldier

13 years. Never Tased or Pepper sprayed anyone, had plenty of good chances to do both. My first instinct is to fight for some reason. I cant count how many times when I was finished, clothes torn, out of breath, and then thought…why the f**k didnt I tase them?

She was already brain dead for running. The cop acted justly.
You crazy kids will hate on cops no matter what. Yeah, sometimes cops
do dumb things, but this is a freak accident and it’s 100% her fault.
    End of story.

To protect and serve…my ass….you can toss that motto in the trash…welcome to AmeriKa the police state.
they treat citizens like the gestapo and they have lost compassion and humanity.

I don’t understand.  She hit her head on the pavement and then sat up and moved her arms and legs several times.  If the fall caused the vegetative state, why wouldn’t that be automatic?  How do we know the coma wasn’t caused by the cocaine and oxycontin?

  • bowrose

oh poor girl , not right tazer …. can you see police belly fat .??? he cant run  that why he is fat ….. he is lazy runing …why he use tazer???
