Excerpted from KENS5: SAN ANTONIO — A student at John Jay High School has been granted permission by the court to continue classes after she was nearly kicked out for refusing to wear an ID that tracks her whereabouts.
Andrea Hernandez, who identifies herself as a Christian, cited religious reasons for not wearing the new student-tracking ID, according to court documents.
The new student ID, known as a SmartID badge, has been implemented as a pilot program at only two Northside ISD schools: John Jay and Jones Middle School.
Hernandez and her father filed a lawsuit after Principal Robert Harris stopped her from petitioning against the ID badge and then threatened to remove her from the school for refusing to wear the new ID.
A judge ruled on Wednesday that the principal’s actions were a violation of the student’s speech and religion. A restraining order was granted that bars Harris from removing Hernandez from the school and interfering with her anti-SmartID message.
